A large number of allottees of Mahira Homes-104, an affordable project, today organised a protest outside the office of the Real Estate Regulatory Authority, Gurugram demanding that the Authority should ensure that the developer should not disappear, as only excavation works have been carried out at the site, after collecting more than Rs.120 crores from the allottees.

Mr Kamal Bhardwaj, President and Mr Ramandeep, Vice President of Mahira Homes-104 Buyers Welfare Association informed that despite various orders by the RERA, Gurugram not to cancel the units of the allottees who have paid atleast 25 per cent cost of the units, the developer, Czar Buildwell Private Limited is adamant to cancel the units to serve its vested interests.

They further informed that the Authority in its order on 22nd August, 2022 in the Suo Moto Complaint No. 2645 of 2022 had directed the developer to take payments from the allottees as construction linked payment plan, but the developer is still demanding payments and is cancelling the units of the allottees illegally, unlawfully and fraudulently.

There are around 1483 affordable units in the project at Sector 104, Gurugram and almost all units have been sold out, and the developer has collected more than Rs.120 crores from the allottees, but presently, no construction works are being carried out at the project site.

The developer has collected atleast 25 per cent cost of the units from the allottees, but, still, the builder has not got executed the Builder Buyer Agreement with allottees as per the RERA norms and regulations.

Mr Abhay Jain, Advocate, counsel of the Association informed that the Authority has already heard the arguments from both the sides, and the judgment is expected shortly. Mr Jain further informed that the promoters of the project are powerful politicians of Haryana and they are trying to influence the judgement to exploit the allottees, who belong to the middle segment of the society.

He added that the land owners of the project site have also lodged a FIR against the developers for committing cheating, fraud and forgery in regard to the collaboration agreement with them. The developer had also diverted huge funds, violating the RERA rules.
